SLAPP is an acronym for a strategic lawsuit against public participation. If Trellis faced a SLAPP action we would file an anti-SLAPP motion.
Anti-SLAPP motions weigh heavily in favor of defendants. And defendants who win anti-SLAPP motions are entitled to reasonable attorney's fees paid by the plaintiff.
As the New York Supreme Court said, SLAPPs are "[s]hort of a gun to the head, a greater threat to First Amendment expression can scarcely be imagined." Gordon v. Morrone, 590 N.Y.S.2d 649, 656 (N.Y. Sup. Ct. 1992).
